Francis Builders Terms of trade


Please read and understand these terms, if you have any questions, please do not hesitate to contact us.


1-Acceptance of Quote

Acceptance of any quote, estimate, or commencement of work confirms acceptance of these Terms of Trade.


2-Validity of Quotes

Quotes are valid for 30 days unless otherwise stated. Pricing may be subject to change if the scope of works changes, material prices increase, or unforeseen site conditions arise.


3-Deposits & Progress Payments

A 10 percent deposit is required to secure scheduling apon acceptance of the quote. 2 weeks out from the agreed start date a further 40 percent deposit will be due to purchase materials. Progress payments may be invoiced during the course of works for labour, materials, and completed stages of work. Final payment is due within 3 days once completion is reached unless otherwise agreed in writing.


4-Payment Terms

Unless otherwise stated, invoices are due within 3 days of invoice date. Failure to make payment by the due date may result in work being suspended until payment is received.


5-Late Payments

Overdue accounts may incur interest at 2% per month plus any debt collection or legal costs incurred recovering outstanding monies.


6-Variations

Any variations or additional work requested by the client that fall outside the original quote may incur additional charges. Variations may affect completion timelines and pricing.


7-Hidden or Unforeseen Conditions

Additional costs may apply where hidden damage, site access issues, weather delays, or unforeseen construction issues are discovered during works.


8-Materials & Supply Delays

Francis Builders is not responsible for delays caused by supplier shortages, freight delays, weather events, council delays, or circumstances outside reasonable control.


9-Client Responsibilities

The client is responsible for providing clear site access, boundary information, and ensuring all necessary permissions or consents are obtained unless otherwise agreed.


10-Workmanship

All work will be carried out with reasonable care and skill in accordance with New Zealand building standards and applicable legislation.


11-Defects & Maintenance

The client must notify Francis Builders of any alleged defects within a reasonable timeframe. Timber movement, shrinkage, natural cracking, and weathering are normal characteristics of timber products and are not considered defects.


12-Ownership of Materials

Materials supplied remain the property of Francis Builders until payment has been made in full.


13-Disputes

Any disputes relating to payments or work undertaken shall first be discussed in good faith between both parties. If unresolved, disputes may be referred under the Construction Contracts Act 2002.


14-Cancellations

If a project is cancelled after acceptance of the quote, the client may be liable for costs incurred, including materials ordered, labour completed, and administrative time.
